Terms of Service

These Terms of Service ("Terms") govern your use of the EcomSwarm platform (the "Service") operated by EcomSwarm Technologies("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using EcomSwarm, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity.

2. Description of Service

EcomSwarm is a multi-agent AI platform that automates COD (Cash on Delivery) e-commerce campaign workflows, including but not limited to: market research, ICP strategy, brand identity generation, landing page creation, image generation, and deployment.

3. Account Registration

You must provide accurate and complete information when registering. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@ecomswarm.com if you suspect unauthorized access.

4. Credits and Usage

The Service operates on a credit system. Credits are consumed when you initiate AI generation tasks. Credits are non-transferable and expire at the end of each billing cycle. Free plan credits are provided on a one-time basis.

5. Payment Terms

Paid plans are activated manually upon receipt of payment via WhatsApp, as described on the pricing page. Subscription periods begin on the date of payment confirmation. We reserve the right to change pricing with 30 days' notice.

6. Refund Policy

Due to the significant API costs incurred for AI generation (LLMs and image providers), we strictly offer no refunds once a generation process has been initiated on your account. We encourage users to test the platform using the free trial tier before committing to a paid subscription.

7. Acceptable Use

You agree not to use the Service to:

• Generate content that violates applicable laws or advertising platform policies
• Produce deceptive, fraudulent, or misleading marketing materials
• Infringe the intellectual property rights of others
• Scrape or automate access to the Service beyond normal usage
• Resell or sublicense access to the Service without our written consent

8. Intellectual Property

You retain ownership of content you upload (product images, descriptions). AI-generated outputs (landing pages, copy, brand assets) are licensed to you under a non-exclusive, worldwide license for commercial use, subject to these Terms. The EcomSwarm platform, agents, and codebase remain our intellectual property.

9. Third-Party Services

The Service integrates with third-party APIs including Anthropic (Claude), Google (Imagen / Gemini), ElevenLabs, SyncLabs, Shopify, Meta, and TikTok. Your use of outputs generated with these services may be subject to their respective terms. We are not responsible for third-party service outages or policy changes.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL ACHIEVE ANY SPECIFIC BUSINESS OUTCOME.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOMSWARM TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account by contacting us at hello@ecomswarm.com.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
